Terms of service

These terms cover your use of potcount (the "service"), a free tool for tracking friendly home poker games. By using potcount you agree to them. If you don't agree, please don't use it.

What potcount is

potcount helps you record buy-ins and top-ups during a poker night and works out who pays who at the end. It is a bookkeeping and calculation aid only.

What potcount is not

  • Not a payment service. potcount does not hold, transfer, process, or touch any money. It does not initiate payments or access bank accounts. All money changes hands directly between players, entirely outside of potcount.
  • Not a gambling service. potcount does not organise or host games, take bets, collect or hold stakes, or charge any rake or fee. It is a record-keeping tool for games that players organise and run themselves.
  • Not a financial service. potcount does not provide financial advice, act as an intermediary for transactions, or operate as a payment institution within the meaning of Dutch or EU financial regulation.

Private games

potcount is for private home games between people who know each other. Each game has a unique code that the host shares with their group.

Real-money gambling is regulated and may be restricted or illegal where you live. You are responsible for ensuring any game you host, join, or play is lawful in your jurisdiction. potcount is a scorekeeping tool, not a licensed gambling operator, and nothing in it should be taken as permission to run or take part in an unlawful game of chance.

Calculations and settlements

potcount does its best to compute correct settlement amounts, but it relies entirely on the numbers you and the other players enter. We do not guarantee that calculations are error-free. Always check the final amounts with your group before any money changes hands.

You and the other players — not potcount — are responsible for agreeing on and settling the actual amounts. Whether, when, and how players pay each other is entirely between them. We have no role in, and accept no responsibility for, those payments — including disputes about whether someone paid, paid the right amount, paid the right person, or paid on time.

Any reminder potcount shows that an unpaid tally exists (for example, "you still owe €20 to a player") is just an informational nudge generated from the numbers players entered. potcount does not verify, collect, or enforce any amount, and is never a party to it.

Payment links

potcount may let you save a personal payment link — for example Tikkie, iDEAL or Revolut — to your profile, and show a "Pay" button to a player who owes you, so they can settle up in one tap. This is only a convenience shortcut, and it does not change anything above:

  • The button simply opens the payment app or link you provided. Any payment happens entirely inside that third-party app, directly between the two players.
  • potcount never processes, holds, initiates, routes, or sees the payment, and is not a party to it. We can't tell whether, when, or how much was actually paid — a "paid" mark is just something a player taps.
  • Each payment provider has its own terms, and some restrict payments connected to gambling. You are responsible for making sure your use of a payment link complies with that provider's terms and with the law where you are.
  • Adding a payment link is optional. It's shown only to the players you're settling a game with — never on your public profile — and you can remove it at any time.

Your responsibilities

  • Use potcount only where it is legal for you to do so, and only for lawful, friendly games.
  • Only share game codes with people you know and trust.
  • Keep your account passcode private — you are responsible for activity on your account.
  • Enter accurate information and treat other players fairly and respectfully.
  • Don't misuse the service: no abuse, automated scraping, attempts to break or overload it, or use of it to harass others.

No warranty

potcount is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by Dutch law. We do not warrant that the service will be uninterrupted, error-free, or that defects will be corrected. This does not affect any mandatory rights you may have under applicable consumer protection law.

Limitation of liability

To the maximum extent permitted by Dutch law, potcount and its operator are not liable for any indirect, incidental, or consequential damages arising from your use of the service — including but not limited to:

  • Financial losses or disputes between players
  • Reliance on potcount's calculations or settlement suggestions
  • Issues arising from players you choose to invite or play with
  • Payments made (or not made) between players
  • Incorrect, mismatched, or missing amounts

potcount is provided free of charge. In any event where we are found liable, our total liability is limited to the amount you have paid for the service.

Nothing in these terms excludes or limits our liability for damage caused by our intentional misconduct or gross negligence, or any other liability that cannot be excluded under mandatory Dutch law.

Your own risk

You use potcount at your own risk. It is a calculation and record-keeping aid that relies entirely on what users enter. All real-world play — winning, losing, agreeing amounts and paying (or not paying) anyone — is between the players involved. Always check every figure with your group before any money changes hands.

Indemnity

To the extent permitted by law, you agree to cover FatCloud against third-party claims and reasonable costs arising from your breach of these terms, your unlawful use of potcount, or any game you host, list, join, or play. This does not apply to the extent a claim results from our own intentional misconduct or gross negligence, and does not affect your mandatory consumer rights.

Events beyond our control

We are not liable for any failure or delay caused by events beyond our reasonable control, including outages, third-party or hosting failures, network issues, or force majeure.

Age requirement

You must be at least 18 years old to use potcount.

Accounts and changes

  • You can stop using potcount at any time and ask us to delete your account and data (see the privacy policy).
  • We may suspend or remove accounts that abuse the service or break these terms.
  • We may update these terms as potcount grows; the date at the top reflects the latest version, and continued use means you accept the changes.

Communications

  • We send service messages about your account (e.g. security or a change to these terms) when needed.
  • Any optional emails — your monthly stats summary and product updates — are sent only if you opt in, as separate choices you can change or withdraw any time in your account settings, and every such email has an unsubscribe link. See the privacy policy.

Governing law

These terms are governed by Dutch law, and disputes will be submitted to the competent court in the Netherlands — without affecting any mandatory right you have as a consumer to rely on the law of, or bring proceedings in, your country of residence.
