These terms cover your use of potcount (the "service"), a free tool for tracking friendly home poker games. By using potcount you agree to them. If you don't agree, please don't use it.
potcount helps you record buy-ins and top-ups during a poker night and works out who pays who at the end. It is a bookkeeping and calculation aid only.
By default, potcount is for private home games between people who know each other. Each game has a unique code that the host shares with their group.
A host may optionally list a game publicly in a city so nearby players can find it and request to join. potcount does not vet, screen, or endorse any player, host, or game, and it does not decide who plays — the host approves or declines every request and is responsible for who they let into their game. Public games are played in blinds as social play; potcount never handles money, stakes, or payments of any kind. We accept no responsibility for the players who request, are invited to, or join any game, their conduct during or after a game, or anything that happens between players.
Real-money gambling is regulated and may be restricted or illegal where you live. You are responsible for ensuring any game you host, list, join, or play is lawful in your jurisdiction. potcount is a scorekeeping tool, not a licensed gambling operator, and nothing in it should be taken as permission to run or take part in an unlawful game of chance.
potcount does its best to compute correct settlement amounts, but it relies entirely on the numbers you and the other players enter. We do not guarantee that calculations are error-free. Always check the final amounts with your group before any money changes hands.
You and the other players — not potcount — are responsible for agreeing on and settling the actual amounts. Whether, when, and how players pay each other is entirely between them. We have no role in, and accept no responsibility for, those payments — including disputes about whether someone paid, paid the right amount, paid the right person, or paid on time.
Any reminder potcount shows that an unpaid tally exists (for example, "you still owe €20 to a player") is just an informational nudge generated from the numbers players entered. potcount does not verify, collect, or enforce any amount, and is never a party to it.
potcount is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by Dutch law. We do not warrant that the service will be uninterrupted, error-free, or that defects will be corrected. This does not affect any mandatory rights you may have under applicable consumer protection law.
To the maximum extent permitted by Dutch law, potcount and its operator are not liable for any indirect, incidental, or consequential damages arising from your use of the service — including but not limited to:
potcount is provided free of charge. In any event where we are found liable, our total liability is limited to the amount you have paid for the service.
Nothing in these terms excludes or limits our liability for damage caused by our intentional misconduct or gross negligence, or any other liability that cannot be excluded under mandatory Dutch law.
You use potcount at your own risk. It is a calculation and record-keeping aid that relies entirely on what users enter. All real-world play — winning, losing, agreeing amounts and paying (or not paying) anyone — is between the players involved. Always check every figure with your group before any money changes hands.
To the extent permitted by law, you agree to cover FatCloud against third-party claims and reasonable costs arising from your breach of these terms, your unlawful use of potcount, or any game you host, list, join, or play. This does not apply to the extent a claim results from our own intentional misconduct or gross negligence, and does not affect your mandatory consumer rights.
We are not liable for any failure or delay caused by events beyond our reasonable control, including outages, third-party or hosting failures, network issues, or force majeure.
You must be at least 18 years old to use potcount.
These terms are governed by Dutch law, and disputes will be submitted to the competent court in the Netherlands — without affecting any mandatory right you have as a consumer to rely on the law of, or bring proceedings in, your country of residence.
